These Terms of Service ("Terms") govern your access to and use of the website digicamstore.in and any related services, tools, content, products, or functionality (collectively, the "Services") provided by Digicamstore ("Digicamstore", "we", "us", or "our").

By accessing, browsing, or using the Services, including by placing an order, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

Your use of the Services is also governed by our Privacy Policy and our Return & Refund Policy, which are incorporated into these Terms by reference.

1. Eligibility & Use of Services

You represent that you:

  1. Are at least the age of majority under applicable law
  2. Have the legal capacity to enter into a binding contract
  3. Will use the Services only for lawful purposes

We reserve the right to refuse service in accordance with applicable law. Any such refusal will not be made on discriminatory grounds prohibited by law.

2. About Digicamstore

Digicamstore is an online store specialising in used, refurbished, and pre-owned digital cameras and accessories.

3. Products & Condition Disclosure

  1. All products sold on Digicamstore may be used or refurbished, unless explicitly stated otherwise.
  2. Product descriptions, images, cosmetic condition, shutter count, and functionality details are provided to the best of our knowledge.
  3. Minor cosmetic wear consistent with normal use does not constitute a defect.
  4. Images may be representative and not of the exact unit unless stated.

You acknowledge and accept the nature of pre-owned products before purchasing.

4. Pricing & Payment

  1. All prices are listed in Indian Rupees (INR) unless stated otherwise.
  2. Prices may change without prior notice.
  3. Payment must be completed at checkout using the payment methods made available via Shopify.
  4. Orders are confirmed only after successful payment authorisation.

We reserve the right to cancel or refuse any order in cases of pricing errors, suspected fraud, or stock unavailability.

5. Orders, Cancellations & Modifications

  1. Orders may only be cancelled before dispatch.
  2. Once shipped, orders cannot be cancelled.
  3. We reserve the right to limit quantities or refuse bulk or reseller orders.

6. Shipping & Delivery

  1. Shipping timelines are estimates and may vary due to courier delays, weather, or other external factors.
  2. Risk of loss passes to you upon delivery.
  3. You are responsible for providing accurate shipping details.

Digicamstore is not responsible for delays caused by third-party logistics providers, except where such responsibility cannot be excluded under applicable law.

7. Returns, Refunds & Exchanges

Return, refund, and exchange eligibility is governed by our Return & Refund Policy, which forms an integral part of these Terms. In the event of any conflict between these Terms and the Return & Refund Policy in relation to returns, refunds, or exchanges, the Return & Refund Policy will govern.

Refunds, if approved, will be processed to the original payment method in accordance with that policy.

8. Warranty Disclaimer

Unless explicitly stated in writing:

  1. Products are sold "as is" and "as available"
  2. No manufacturer warranty is provided
  3. Any limited store warranty, if offered, will be clearly disclosed on the product page

To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Nothing in these Terms excludes, restricts, or modifies any statutory rights, guarantees, or remedies available to you under applicable law, including the Consumer Protection Act, 2019, that cannot lawfully be excluded — for example, your remedies where a product is defective, deficient, or not as described.

9. User Accounts

If you create an account:

  1. You are responsible for maintaining the confidentiality of your login credentials
  2. You are responsible for all activity under your account
  3. We may suspend or terminate accounts for misuse or violation of these Terms

10. Intellectual Property

All content on the Services, including logos, images, text, graphics, and design elements, is owned by or licensed to Digicamstore and protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or exploit any content without prior written permission.

11. Prohibited Conduct

You agree not to:

  1. Violate any applicable law or regulation
  2. Engage in fraudulent transactions or misuse payment methods
  3. Interfere with or disrupt the Services
  4. Attempt unauthorised access to systems or data
  5. Resell products without prior written consent

12. Limitation of Liability

To the maximum extent permitted by law:

  1. Digicamstore shall not be liable for indirect, incidental, special, or consequential damages
  2. Our total liability arising from any claim shall not exceed the amount paid by you for the product giving rise to the claim

Nothing in these Terms limits or excludes liability where such limitation or exclusion is not permitted by applicable law, including liability for defective goods or deficiency in service under the Consumer Protection Act, 2019.

13. Indemnification

You agree to indemnify and hold harmless Digicamstore, its owners, employees, and partners from any claims, losses, or damages arising out of:

  1. Your breach of these Terms
  2. Your misuse of the Services
  3. Your violation of any law or third-party rights

14. Termination

We may suspend or terminate your access to the Services if you violate these Terms or applicable law. Where reasonable and lawful to do so, we will provide notice.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to the paragraph below, courts located in New Delhi, Delhi shall have jurisdiction over any disputes.

If you are a consumer, nothing in these Terms affects your statutory right to bring proceedings before, or seek remedies from, the Consumer Disputes Redressal Commission having jurisdiction under the Consumer Protection Act, 2019, including at the place where you ordinarily reside or work.
